Indochina Tourist & Trade Co., Ltd. (“IT&T” or “we”) welcomes you (the “Customer” or “you”) to its website (the “Site”).

References to the Site are deemed to include derivatives thereof, including but not necessarily limited to mobile websites and applications. The Terms of Service, as defined below, apply to our services, directly or indirectly made available to you through whatever means, including online reservations, customer service requests or otherwise. By accessing, browsing, downloading any material and using the Site, you acknowledge and agree having read, understood and agreed to the Terms of Service.

Our different policies and guidelines, which can be found throughout the Site, including but not limited to, the Cancellation Policy, Privacy Policy, etc. (collectively the “Policies”), should be read in conjunction with and are an integral part of these terms and conditions and are hereby included by reference. The terms and conditions set out below and the Policies are collectively referred to as the Terms of Service.

If you do not agree to the Terms of Service, please cease use of the Site immediately. The Terms of Service, as may be amended from time to time, constitute the entire agreement, and supersede any other agreements or understandings (oral or written), between you and IT&T with respect to their subject matters unless explicitly stated otherwise.

By visiting the Site, you agree that the laws of the Socialist Republic of Vietnam, without regard to principles of conflict of laws, will govern these Terms of Service and any dispute of any sort that might arise between you and IT&T.

IT&T makes every effort to ensure that any materials or prices displayed on this Site are accurate as at the date of issue. Changes in market conditions or circumstances may occur after the issue date which may make information displayed on this website no longer accurate or no longer reflect the current position.

IT&T hereby expressly disclaims any representation, warranty or undertaking in relation to the accuracy, completeness, quality or adequacy of any contents of this Site.

While IT&T makes every effort to work with suppliers which provide an acceptable standard of service and accommodation for the price paid, we hereby expressly disclaim any representation, warranty or undertaking in relation to the quality or adequacy of any supplier listed on our website.

THIS SITE AND ALL CONTENTS OF THE SITE ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY. YOU ACKNOWLEDGE, BY YOUR USE OF THE SITE, THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK, THAT YOU ASSUME FULL RESPONSIBILITY FOR ALL COSTS ASSOCIATED WITH ALL NECESSARY SERVICING OR REPAIRS OF ANY EQUIPMENT YOU USE IN CONNECTION WITH YOUR USE OF OUR SITE, AND THAT IT&T SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND RELATED TO YOUR USE OF THIS SITE.

Images displayed on the Site are not claimed to be created by or owned by the Site or Site’s authors. Images seen on the Site have been collected from media galleries of suppliers, partners, tourism promotion organizations, plus numerous sources in the public domain across the internet including forums, submissions from visitors, search results from world popular search engines and websites directed from those searches.

If you see your images on the Site, you can have an accreditation and link placed by the images or have the images in question removed with proof you are the creator and/or the respectful copyright owners of those images.

IT&T would like to identify and credit creators where possible and welcome requests to showcase an author’s work. To request either option, please contact us and provide 1. The page and name of the images you claim ownership to as featured in the Site, 2. Proof of ownership or reasonable evidence that you are the creator of the images in question, 3. Whether you would like your images removed or your accreditation added and 4. Your contact details.

The Hotel star ratings are provided for your information only. The star ratings are based on information we have received from our suppliers. IT&T does not independently verify star ratings. Please be aware that star ratings can vary greatly on the basis of location, available alternatives, local market conditions, practices or other circumstances. Thus, it is possible that a star rating in one particular country or city is not comparable to the same star rating in another country or city due to such circumstances.

For certain Hotels, compulsory service fees will be charged on top of the room rate at the request of the Hotel, or at your option where available. These services are inclusive but not limited to meals and transportation.

Compulsory transportation service is especially common for island destinations (e.g. Con Dao Islands) where you need Hotel transportation to reach the Hotel. Please note that this is always organized by and offered by or on behalf of the Hotel, who is responsible for such transportation services, not IT&T. IT&T does not assume any liability for the quality, safety, frequency or service levels of such transportation services.

In rare cases, IT&T may also have to cancel or reject a booking due to “obvious errors”, independent of the origin of such errors. For clarity, an obvious error is a mistake on the Site (e.g. in terms of price) which a reasonable person would not consider to be normal. Whether to cancel or reject a booking for this reason is in IT&T’s sole discretion.

IT&T is not itself a carrier or hotelier, nor do we own aircrafts, hotels or coaches. The flights, coach journeys, other travel and hotel accommodation comprised in your booking are provided by reputable carriers and hoteliers on their own conditions. It is important to note, therefore, that all bookings with IT&T are subject to the terms and conditions of the relevant service providers some which limit or exclude liability in respect of death, personal injury and loss or damage to baggage.

The standards of accommodation and other services contained in this Site are based on various factors, which are generally accepted as indicative of a certain class. IT&T does not accept any liability of whatever nature for the acts, omissions or default, whether negligent or otherwise, of those service providers in connection with your passengers’ tour pursuant to a contract between them and your passengers and over whom we have no direct control. IT&T does not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure, or other events which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbances, fire, floods, unusually severe weather, acts or God, acts of Government or any other authorities, accidents to or failure of machinery or equipment or industrial action.

Some tours require a minimum number of passengers to operate. If minimum numbers are not achieved, tours may be cancelled at short notice. Some suppliers also reserve the right to cancel departures for other reasons, some which may be affected by weather conditions. Please enquire at the time of booking for these special terms and conditions. Some tours and itineraries may also vary and attractions may be substituted due to seasonal conditions. IT&T will not be held liable for a service variation, cancellation, delay or withdrawal, or a Supplier’s failure to notify you.

IT&T reserves the right to make changes to the Site and the Terms of Service at any time.
